Terms of Sale

Effective Date: May 9, 2018

In addition to the Terms of Use of the Website and the Privacy Policy, the purchase of products offered for sale on the Website is subject to these legally binding General Terms and Conditions of Sale (the “Terms of Sale”), which hereby incorporate the terms and conditions contained in the Terms of Use.

1. General

The Company may update these Terms of Sale at any time without prior notice by posting them on this Website. For each order you place with the Company, your acceptance of the Terms of Sale in force as of the date of your order is required. The Terms of Sale in effect at the time of your order will govern that transaction. Products purchased from the Company are meant solely for personal use. Purchasing products for commercial resale is strictly prohibited. When you purchase a product, you represent and warrant that you are purchasing the product for personal and not commercial purposes and that you do not intend to resell Company products for commercial purposes. The Company is only responsible for products purchased directly from the Company. If you purchased any Company products from an outside retailer and would like to return or exchange it, you must bring the product to the original retailer where it was purchased.

2. Placing an Order

Customer Account

The Company may require you to create an account or log in to your existing account in order to place an order on the Website. Your username and password are for your personal use only. You are responsible for maintaining the confidentiality of your username and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. In no event shall the Company be liable for any loss, theft or fraudulent use of your account. In such a case, you should inform the Company immediately.

Placing an Order

Product orders are placed though our order form. Once we receive your order form and confirm your order, we will invoice you for payment. Orders are restricted for shipment to the United States of America, excluding Puerto Rico, Guam and all other U.S. possessions and territories situated outside North America. Before submitting an order form, you should first confirm that all the information submitted accurately reflects your selection. Upon submission, your order will be processed and invoiced. While every effort is taken to try to ensure that the coloring, design and style of the Company products in the photographs displayed on the Website are representative of the original products, variations may occur due to technical restrictions of color reproduction on your computer or mobile device. The Company reserves the right to reject or to cancel your order in its sole discretion for any reason without liability. 3. Product Availability

Products offered for sale and displayed on the Website are subject to availability. The Company shall not be liable in case of stock outage or unavailability of products. The Company reserves the right to change the products offered for sale on the Website at any time and without notice. Details about the availability of products are provided when you place your order. At times, errors may exist. If a product is not available after you have placed your order, we will inform you by email or by telephone as soon as possible. You will be invited to choose another available product as substitution for the unavailable product or to cancel your order. If you cancel your order, you will be refunded. Customized products cannot be cancelled once the order is placed.

4. Order Confirmation

Once your order is submitted for processing you may not make any changes to or cancel the order, except as expressly provided in these Terms of Sale or applicable law. The submission of your order means your acceptance of the Terms of Sale.

 

5. Pricing and Payment

All prices of Company products are indicated in United States dollars, excluding taxes and shipping costs (unless expressly indicated upon checkout). The Company reserves the right to modify the prices of products offered on the Website at any time without prior notice. You will be charged the prices displayed on the Website at the time your order was submitted provided the product ordered is available.

Payment is due immediately upon your receipt of an invoice for your order. Credit and debit cards are the only methods accepted for payment on the Website. All orders are payable in United States dollars. We accept the following charge cards and credit cards: MasterCard®, Visa®, Discover®, and American Express®. Your order will only be shipped once we have verified your payment method and received authorization to process your payment.  

6. Shipping and Delivery

Products will be shipped to the delivery address specified during the ordering process provided such address is located within the Company’s delivery territory as set forth above. Any delivery address located outside of the territory will be refused during the ordering process. Products may only be delivered to a physical street address within the territory. The Company will not process any order for which a post office box address is provided. You will be asked to select the shipment method you would prefer as part of the order process, and agree to pay the shipping costs indicated thereon. When you submit your order we will inform you of the method(s) of delivery available for the product(s) purchased.

Any failure to deliver or late delivery exceeding eight (8) business days should be reported to Customer Service as soon as possible. In order for your claim to be accepted, notify us within ten (10) business days from the date of confirmation of your order. You should check that your shipment is correct on delivery.

7. Returns

At this time, all sales are final. Due to the finality of your purchase, please confirm all products ordered before submitting your purchase. If you have questions regarding any product, do not hesitate to use the Contact Us form to reach out to us, and we will be happy to help.  If there is an error in your shipment, such as incorrect items received, please Contact Us within 48 hours of receiving your shipment.

8. Reservation of Title

All products remain the property of the Company until payment in full is made to the Company. In case of a payment dispute, you agree to return the received products to the Company immediately upon request, and to assume the risks (in particular the loss, theft or damage) relating to the delivered products.

9. Disclaimer of Warranty

THE PRODUCTS ARE SOLD ON AN "AS IS", "AS AVAILABLE" BASIS AND WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER IMPLIED OR BY LAW, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, WORKMANLIKE MANNER, QUALITY, ACCURACY, AND/OR TITLE.

10. Miscellaneous

These Terms of Sale shall be interpreted together with the Terms of Use, including but not limited to Sections 4 and 5.  Any disputes under these Terms of Sale shall be governed by Section 5 “Other Provisions” of the Terms of Use.
